1. The booking terms and conditions form
the sole contract between the owner [referred to as we]
and the person signing the booking form, who must be over
18 years of age and who shall be deemed to sign this form
on behalf of all of the persons herein. No contract shall
exist until we have received a signed booking form together
with the correct ‘security/booking deposit’ and/or ‘full
payment’, and we have confirmed the reservation in writing.
Before booking, it is recommended that you telephone or
send an email to check availability, giving if possible,
a second choice departure date. Your booking can be made
provisionally, if required, and held for a maximum of 7
days to allow time for your completed booking form and ‘security/booking
deposit’ and/or ‘full payment’ to be received.
2. The balance should be paid not later
than 8 weeks prior to departure. If a booking is made within
the 8 week period, ‘full payment’ plus ‘security/booking
deposit’ must be received before the booking can be confirmed.
3. A ‘security deposit’ is required
with the final balance. This is used to cover excessive
use of electricity, excessive cleaning costs, any chargeable
telephone calls, damages, breakage and
loss to any of the villa contents and alike. The ‘security deposit’
less any such charges will be refunded, as soon
as the inventory and occupancy report are completed
after departure. Guests are liable for all
damage and loss to the villa during their stay. We a reserve the right to refuse entry at any time. PLEASE NOTE
THAT THE BOOKING DEPOSIT WILL BE FOREFITTED IF YOU DO NOT
PAY THE FINAL BALANCE DUE.
4. The accommodation rates quoted are
per week [not per person], and include electricity, air
conditioning, heating [when applicable], TV, linens &
towels, unless otherwise stated on your booking form. Some toiletries and/or sundires may be supplied but it is not the responsibility of the owners to supply and/or replenish such items.
5. Please note that SMOKING IS NOT PERMITTED
INSIDE THE VILLA, though it is permitted on the patio area
by the pool. This keeps the villa odour and allergen free and also avoids
the trouble of sophisticated smoke detectors being triggered
by the cigarette smoke. If evidence of smoking in the villa
is discovered, this will be taken into account when assessing
your ‘security/breakages deposit’, and your co-operation
is therefore requested and appreciated.
6. The accommodation may not be sub let by you under any circumstances whatsoever, nor assigned by you. With our express written agreement, you may share the accommodations for the period specified in writing with the persons specified in writing to you for the fee [if applicable] specified to you in writing. Otherwise
only by persons detailed on the booking form are permitted
to stay at the villa. Please note that contravention
of the above will render your booking void and all moneys
will be forfeited. No pets allowed in the villa at any time.
7. The rental period begins at 1600 hours
on the day of arrival and terminates at 1000 hours on the
day of departure, unless agreed otherwise in writing to you. The villa is cleaned and inspected both
before and after each rental period to ensure guests have
a comfortable stay. Lawn, pool, pest care etc are provided on a
regular basis.
8. Cancellations must be confirmed to
us in writing. In the event that you cancel your reservation,
or we have to cancel the arrangements due to non payment
of the balance due within the time allowed before departure,
cancellation charges will be made as follows:-
For cancellation by you: Within 8 weeks of date of arrival = full payment due less any security deposit paid
Within 12 weeks of planned date of arrival = booking deposit only
More than 12 weeks before planned date of arrival = none
For cancellation by us: For non payment of final balance = booking deposit
9. You are strongly recommended to take
out adequate holiday/vacation insurance to cover possible
cancellation as soon as your reservation is confirmed.
10. We cannot accept liability for death,
personal injury, sickness, accident, delay or loss of luggage
or personal effects or any other loss or misadventure which
may occur whilst renting the villa. Use of the pool is entirely
at your own risk. It is particularly important that children
are supervised at all times in and around the pool area.
11. Force Majeure. We accept no responsibility
for liability for any loss or damage or alteration to the
terms of your reservation caused by events beyond our control,
including, but restricted to, war, terrorist activity, civil
commotion, flight delays or cancellations, airport closures,
adverse weather conditions, fire, flood or industrial dispute.
12. We cannot accept any liability for
failure of public supplies such as water, electricity, gas
supplies or air conditioning systems, or of pool heaters.
Nor for the consequences of the actions or omissions of
persons who may control or supply main services, or any
actions taken in the vicinity of the property, by any authority
over which there is no control.
13. We cannot accept any liability for
your personal safety during your stay. You are
reminded to exercise care as to your personal safety, and
the safety of your companions. Whenever possible, valuables
should be left in a secure place and out of sight.
14. ALL VISITORS SHOULD POSSESS VALID PASSPORTS
AND ANY VISA REQUIRED. All British citizens require a full
10-year passport valid for a period of at least 6 months
beyond the holiday/vacation return date. The majority of
visitors to the USA from Britain no longer require a visa
as a result of the Visa Waiver Programme. It is, however,
the holidaymaker’s responsibility to make sure that they
have all the correct travel documents. If you have any queries
you are advised to contact eh US Embassy for details. We
cannot accept liability for any aforementioned conditions
not being met or any refusal of passage, or changes made to immigration/border control etc., subsequent to this advice being written.
15. We reserve the right to decline or
retain any person as a client whose conduct is ‘deemed to
be disruptive’ and affects the enjoyment of other holidaymakers/residents.
We shall be under no liability to accept any costs incurred,
or responsibility for, any such person.
16. All descriptions given on the web
site are made in good faith. All E&OE.
Should you experience any problems whatsoever with
our home during your stay, please contact the owners immediatley, who will
do their best to assist and rectify the matter as son as
practically possible. We cannot resolve a problem for you
unless we are notified of it at the time. Please
give us the ‘opportunity’ to correct matters. Should a problem
remain unresolved, you are asked to notify us in writing
within 7 days of your return. No action can be taken or
liability accepted for any complaints received after this
period. We aim to resolve complaints within a 2-month period
from receipt, the details of which will be kept confidential
to only the parties involved. Please note that, as Florida
is a tropical State, insects such as ants and the like are
occasionally inevitable, and are not cause for complaint.
